LEGAL / TERMS OF USE (PLANNING TOOL ONLY)
CHIP is a planning and estimating tool intended to assist with generating cut plans, material totals, and related outputs based solely on user-supplied measurements, quantities, and selections (the “Inputs”). CHIP may apply assumptions, default settings, rounding, waste factors, optimization logic, or other industry-standard heuristics to produce workable layouts and summaries (the “Outputs”). Outputs are informational only and are not a substitute for professional judgment, site verification, field measurement, code compliance review, or trade-qualified supervision. You acknowledge and agree that construction conditions vary materially from job to job and that you remain solely responsible for confirming all dimensions, opening sizes, jamb conditions, reveals, material profiles, site tolerances, and installation requirements prior to ordering, cutting, or installing any materials.
User Responsibility for Inputs; Verification Required
You are solely and entirely responsible for: (a) the completeness and accuracy of all Inputs; (b) confirming units of measure; (c) verifying door and window openings, rough openings, finished openings, and site conditions; (d) validating Outputs against your own measurements and methods; and (e) determining the suitability of any Output for your specific project. CHIP is not responsible for errors arising from inaccurate Inputs, wrong units, incorrect selections, misunderstanding of options, failure to verify openings, or failure to confirm assumptions. You agree that you will not order, cut, or install materials based on CHIP without independently confirming that the Outputs are correct for the specific job.
No Warranties (As-Is / As-Available)
CHIP is provided “AS IS,” “AS AVAILABLE,” and “WITH ALL FAULTS,” without warranties of any kind, whether express, implied, statutory, or otherwise. Without limiting the foregoing, CHIP expressly disclaims any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, and error-free operation. We do not warrant that Outputs will be correct, complete, suitable, or sufficient for any particular job, nor that access to CHIP will be uninterrupted or free of delays, outages, bugs, or third-party failures.
Service Availability; Maintenance; No SLA
CHIP may be unavailable from time to time due to maintenance, updates, hosting disruptions, Google/Apps Script limitations, third-party outages, email provider filtering, network failures, or other causes beyond our reasonable control. We may, but are not obligated to, perform maintenance, updates, repairs, or improvements. We do not provide any service-level agreement (SLA), guaranteed uptime, guaranteed response times, guaranteed delivery times, or guaranteed support turnaround. You acknowledge that downtime, delays, and service interruptions may occur and agree that such events do not constitute a breach and do not entitle you to refunds, credits, or compensation, except where expressly stated otherwise in writing by CHIP.
Data Retention (Temporary Job Files)
Job files and generated artifacts may be stored temporarily to enable edits, delivery, and reporting. Unless otherwise stated, job files are intended to be deleted within forty-eight (48) hours. You acknowledge and agree that deletion timing is a target and not a guarantee, and may be affected by operational constraints, technical limitations, or third-party systems. CHIP is not responsible for any loss of data, job files, or artifacts. You are responsible for downloading, saving, and backing up your Outputs.
Email Delivery; User Obligations
Outputs and reports may be delivered by email. Delivery may be delayed or prevented by spam filters, email provider policies, incorrect email entry, inbox capacity limits, or other factors outside our control. You are responsible for entering a correct email address and checking spam/junk folders. CHIP is not responsible for failed delivery due to user error or third-party email filtering. Where possible, we may provide alternate retrieval methods; however, we do not guarantee alternate delivery.
Purchases; Refund Policy (Job Runs)
Refunds (if any) are limited to situations where CHIP produces an incorrect Output due solely to a verified mathematical or calculation error in CHIP’s logic, as determined by CHIP in its discretion after reasonable review. Refunds are not provided for incorrect Inputs, wrong units, incorrect selections, failure to verify openings, misunderstanding of Outputs, changes in site conditions, material defects, supplier issues, scheduling impacts, labor costs, or any other non-software causes. To request a refund, you may be required to provide sufficient evidence to reproduce the issue (including Inputs and screenshots). Refunds, if approved, will be limited to the amount paid for the specific run associated with the verified calculation error.
Pass Keys; License Limits; Abuse
Pass keys are issued to a single end user and may not be shared, resold, sublicensed, transferred, or used for automated access, scraping, scripted abuse, or circumvention of usage limits. Any attempt to share, resell, or misuse a pass key may result in throttling, suspension, or permanent disabling of the key without notice. We reserve the right to implement and modify usage limits, rate limits, run caps, and validation mechanisms at any time to protect system integrity and fair use.
Twelve-Month Passes; No Refunds; No Proration
Twelve-month passes are non-refundable and non-prorated for any reason, including (without limitation) downtime, maintenance, third-party outages, feature changes, pricing changes, limit changes, reduced availability, user dissatisfaction, inability to use the service, or discontinuation of the service. By purchasing a twelve-month pass, you acknowledge and agree that you are purchasing access for a fixed term subject to “as-available” operation, and that you assume the risk of service interruptions and changes. No credits, partial refunds, or compensation will be provided for unused time, unused runs, or perceived loss of value.
Changes; Suspension; Discontinuation
We may modify, update, suspend, restrict, or discontinue CHIP (in whole or in part) at any time, with or without notice, including changing features, limits, workflows, supported options, pricing, access methods, or delivery methods. If CHIP is discontinued, your sole remedy is to stop using the service. To the maximum extent permitted by law, discontinuation does not entitle you to refunds, credits, compensation, or damages, including for twelve-month passes.
Limitation of Liability; Exclusion of Damages
To the maximum extent permitted by applicable law, in no event shall CHIP (including its owner, operators, contractors, licensors, and suppliers) be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, business opportunities, goodwill, data, materials, time, or anticipated savings, arising out of or relating to: (a) the use of or inability to use CHIP; (b) reliance on Outputs; (c) downtime, delays, or outages; (d) email delivery failures; (e) third-party service interruptions; or (f) any materials ordered, cut, installed, or wasted, even if advised of the possibility of such damages.
Liability Cap
To the maximum extent permitted by applicable law, CHIP’s total aggregate liability for any and all claims arising out of or relating to the service, the Outputs, or these terms, shall not exceed the total amount actually paid by you to CHIP for the specific purchase giving rise to the claim.
Indemnity
You agree to defend, indemnify, and hold harmless CHIP and its owner/operators from and against any claims, demands, actions, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your Inputs; (b) your use of CHIP; (c) your reliance on any Outputs; (d) your ordering, cutting, installing, or use of materials; or (e) your violation of these terms.
Governing Law; Venue
These terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of laws principles. You irrevocably submit to the exclusive jurisdiction of the courts located in Alberta, Canada, for any dispute arising out of or relating to CHIP, the Outputs, or these terms.
Severability; Entire Agreement
If any provision of these terms is determined to be unlawful, void, or unenforceable, that provision shall be deemed severed and the remaining provisions shall remain in full force and effect. These terms constitute the entire agreement between you and CHIP with respect to the subject matter hereof and supersede all prior or contemporaneous understandings, communications, or agreements.
ACKNOWLEDGEMENT
By accessing or using CHIP, you acknowledge that you have read, understood, and agree to be bound by these terms, and that you are legally competent to enter into these terms. If you do not agree, you must not use CHIP.
PRIVACY POLICY
1. Zero Ads, Zero Data Selling We built this tool to calculate trim, not harvest your personal info. We will never put ads on this site, and we do not sell, rent, or trade your data to third parties. Period.
2. Job Data is Temporary (48-Hour Wipe) The measurements and inputs you punch into the calculator are used for one thing: generating your outputs. Job files, inputs, and generated artifacts are wiped from our system within 48 hours of use unless otherwise noted. Your clients' dimensions are your business, not ours.
3. Emails & Passkeys We do not spam. We store partial email addresses strictly for the production, verification, and management of your passkeys.
4. Payment Information When you purchase a run or a passkey, your payment is processed securely by our third-party payment provider Stripe. CHIPTRIM does not collect, see, or store your credit card numbers or bank information.
5. Analytics & Cookies We use standard, basic analytics (like Google Search Console) simply to see how much traffic the site is getting and to make sure the calculator isn't crashing. We also use basic functional cookies—these are just required to keep your session active while the calculator runs your numbers. No creepy cross-site tracking.
